- If you cancel or fail to show up without providing at least 48 hours’ notice, your deposit will be forfeited.
- Rescheduling is subject to availability and may require an additional deposit or fee if the change significantly impacts our schedule.
2.3 Force Majeure Exceptions
Exceptions to the above may apply in cases of force majeure, including:
- Documented severe illness or injury.
- Natural disasters (e.g., floods, earthquakes).
- Government restrictions (e.g., travel bans, lockdowns).
In such cases, we will attempt to reschedule your project without additional fees where possible.
3. Creative Style and Editing Policy
3.1 Acknowledgment of Style
By booking Noire au Noire, you confirm that you have reviewed our portfolio and understand our creative style, which reflects our artistic vision.
3.2 Final Edits
Once the final edits are delivered:
- Refunds will not be granted for dissatisfaction with the style or creative direction.
- Additional edits or revisions can be arranged in a one-on-one session for an extra fee, based on the scope of work required.
4. Limitation on Legal Action
4.1 Waiver of Legal Action
By engaging with Noire au Noire, you agree to:
- Waive the right to pursue lawsuits, class-action claims, or arbitration against Noire au Noire, its employees, or representatives.
- Resolve disputes through mediation as the first and sole step, with costs shared equally.
4.2 Governing Law
Disputes that cannot be resolved through mediation will be governed by the laws of Belgian law . This clause does not limit your statutory rights under EU law.
5. Liability Limitation
5.1 General Liability
Noire au Noire’s liability is limited to the total amount paid by the client for the specific service in question.
5.2 Exclusions
Noire au Noire is not liable for:
- Indirect, incidental, or consequential damages.
- Unexpected outcomes related to creative direction or client preferences.
5.3 Exceptions
This clause does not limit liability for gross negligence, personal injury, or statutory violations as defined by EU law.
6. Indemnity Clause
Clients agree to indemnify and hold harmless Noire au Noire, its employees, and representatives from any claims, damages, or losses arising from:
- Misuse of our services.
- Breach of these terms.
7. No Warranties Disclaimer
All services are provided "as is," with no warranties, express or implied, including but not limited to:
- Fitness for a particular purpose.
- Guaranteed results or specific outcomes.
Noire au Noire is not responsible for client dissatisfaction that falls outside the agreed scope of work.
